Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Colibri Consulting DOO, Jurija Gagarina 231/329, 11197 Novi Beograd, Republic of Serbia (registration MB: 21962651, tax ID PIB: 114045995) (“we”, “us”, “BrainLadders”), governing your use of the BrainLadders mobile application (the “App”) and the website at brainladders.com (the “Site”). BrainLadders is operated under the 1130 Studio brand.

By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old (or 16 in jurisdictions where that is the minimum digital-consent age) and able to enter a binding contract under the law of your country of residence.

2. Your account

You are responsible for keeping your sign-in credentials secure and for all activity on your account. One person may hold one account. Creating multiple accounts to manipulate the leaderboard, self-refer, or evade a ban will result in suspension or permanent termination.

3. User conduct, content, and zero-tolerance policy

BrainLadders is a competitive multiplayer game with a public leaderboard. Your display name and other content you submit are visible to other players. We operate a zero-tolerance policy for objectionable content and abusive behaviour. You agree not to:

• choose a display name or avatar that is obscene, threatening, hateful, sexually explicit, or that impersonates another person;
• harass, threaten, stalk, or discriminate against other players through any in-app channel;
• post or transmit content that is illegal, defamatory, infringes intellectual-property rights, or contains malware;
• cheat, exploit bugs, use bots, scripts, modified clients, or any tool that gives an unfair advantage;
• attempt to manipulate quiz results, MMR, or the leaderboard, or to extract data through scraping or reverse engineering;
• disrupt the service, attack our infrastructure, or interfere with other players’ experience.

Reporting: if you see a display name, duel code, message, or behaviour that violates these rules, email us at contact@1130.studio with the subject “Abuse Report” and include the offending user’s display name (or duel code) and a short description of what happened. A screenshot is helpful but not required.

Our action: we review abuse reports within 24 hours of receipt. We may, at our discretion and without prior notice, remove offending content, force a name change, mute, suspend, or permanently terminate the responsible account. Severe violations (threats of violence, sexual content involving minors, etc.) are reported to the relevant authorities.

4. Fair play and anti-cheat

BrainLadders uses server-side time validation and other anti-cheat measures. Any attempt to manipulate quiz results, exploit bugs, or gain unfair advantages will result in disqualification, loss of rating, and may result in a permanent account ban.

5. Premium subscription

BrainLadders offers an optional auto-renewing Premium subscription (“Premium”). The following terms apply to all Premium subscriptions; additional terms may appear on the in-app purchase screen at the time of subscription.

• Title and length of the subscription period: Premium — 1 month per billing period (other periods, if offered, are disclosed in the App at the time of purchase).
• Price per period: USD 4.99 per month, or the equivalent in your local currency as shown by the App Store or Google Play before you confirm the purchase. Apple and Google may apply local taxes.
• Payment: payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Auto-renewal: your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID or Google Play account within 24 hours before the end of the current period.
• How to manage and cancel: you can manage and cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS) or in your Google Play account (Play Store → Profile → Payments & subscriptions → Subscriptions). Deleting the App or your BrainLadders account does not cancel the subscription.
• Free trials and introductory offers: if a free trial or introductory offer is included, any unused portion of the trial is forfeited when you purchase the subscription.
• Refunds: refunds are handled by Apple and Google according to their policies. We do not process refunds directly. Visit reportaproblem.apple.com for App Store purchases, or the Google Play refund page for Play Store purchases.

6. License (EULA)

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App for non-commercial personal entertainment, subject to these Terms.

iOS: the App is licensed, not sold. If you obtained the App from the Apple App Store, your licence is also subject to the Apple Licensed Application End User License Agreement (the “Apple Standard EULA”); these Terms apply in addition. To the extent of any conflict, these Terms control, except where the Apple Standard EULA cannot be lawfully overridden, in which case the Apple Standard EULA controls.

Android: if you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service.

You may not, and may not allow any third party to:

• copy, modify, translate, or create derivative works of the App;
• reverse engineer, decompile, or disassemble the App;
• rent, lease, sublicense, sell, or otherwise commercially exploit the App;
• remove or alter any proprietary notices.

7. Intellectual property

The App, the Site, the BrainLadders name and logo, the quiz content, and all related materials are owned by Colibri Consulting DOO or its licensors and are protected by intellectual-property laws.

8. Termination

You may stop using the App at any time and delete your account from the Delete Account page. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued operation becomes commercially unviable. Termination does not entitle you to a refund of any unused portion of a Premium subscription, except where required by law.

9. Disclaimer and limitation of liability

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, BrainLadders, Colibri Consulting DOO, and its directors, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the App. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid us for the App during the 12 months preceding the claim.

Nothing in these Terms excludes any liability that cannot be excluded under applicable consumer-protection law.

10. Apple-specific terms

The following applies if you downloaded the App from the Apple App Store: Apple is not a party to these Terms; the agreement is between you and Colibri Consulting DOO. Apple is not responsible for the App or its content. To the extent permitted by law, Apple has no warranty obligation with respect to the App. Apple is, however, a third-party beneficiary of these Terms and has the right to enforce them against you.

11. Governing law and dispute resolution

These Terms are governed by the law of the Republic of Serbia, without regard to its conflict-of-laws rules. The courts of Belgrade, Serbia have exclusive jurisdiction, except that consumers may also bring proceedings in the courts of their place of habitual residence as provided by mandatory consumer law.

12. Changes

We may update these Terms to reflect changes to the service or the law. For material changes we will notify you in-app or by email before the changes take effect. Continued use of the App after the effective date means you accept the new Terms.
